I consulted with BoyarMiller and spoke with senior partner Christopher Burt regarding a trust litigation matter involving a Trust Certification of Incapacity (TCIP). During the consultation, the TCIP and its authority implications were not meaningfully engaged with, and the matter was framed as a routine trust administration issue rather than a dispute centered on an incapacity certification and related authority questions. Following that consultation, I continued investigating the matter independently and identified issues with the TCIP that I believed were central to the case. I later retained a national securities litigation firm, which viewed the TCIP and related compliance issues as central and agreed to take the case on contingency. The matter is now proceeding in FINRA arbitration. My takeaway is that matters involving unusual trust instruments, incapacity certifications, or broker-dealer compliance issues may require highly specialized experience. This review reflects my personal experience only; others may have different outcomes depending on their circumstances.
